How The FAA "Works"

According to Kori Blalock Keller, spokesperson for PASS, Professional Aviation Safety Specialists -- an association that represents FAA Inspectors -- the American public isn't aware that FAA inspectors rarely are able to check
aircraft at repair stations overseas.
"The process for
traveling overseas to inspect a repair station is so labor intensive,
often involving state department coordination and country clearances,"
she said, "an FAA inspector can wait a month or longer for clearance.
When an inspector is able to get to the foreign repair station, many
times, the aircraft slated for inspection has since left or the repair
station is fully aware of the visit. So, the element of surprise is
nonexistent, rendering the inspection a simple formality."
Tom Brantley, President of PASS, gave testimony to Congress stating, "Although the written version of the FAA's
mandate instructs the agency to focus on maintaining and enhancing
safety, there's pressure on inspectors to promote the aviation
industry--even if it's at the sacrifice of safety enforcements."
Currently,
if an inspector finds a violation while conducting an on-site
inspection of an air carrier, the inspector first must notify the
carrier and the supervising inspector on location. The air carrier
inspector then enters information into the Air Transportation Oversight
System database. Keeping commercial aviation separate from
private general aviation, GA data is entered into the Program Tracking
Reporting System. At this stage, the inspector has the ability
to open additional records, tracking enforcement actions through FAA
Enforcement Information System.
However, the system
doesn't work as intended to protect the safety of airline passengers.
After entering all info and researching the issue, and if approved to
move forward by the system, the inspector makes a recommendation to use
administrative actions: warning notices; letters of correction or
investigation; and legal sanctions, to include fines, suspension or
revocation of a carrier's operating certificate. "Seasoned safety
inspectors report that filing an enforcement action against an airline
is often futile; there's little chance that the enforcement process
will work as intended," Brantley explained "If the many required steps
are executed properly by the inspector, an enforcement action may never
leave the inspector's office, if it's not moved forward by FAA
management."
What happens is that a suspension or revocation
action can sit for six months; once inactive for six months, such
recommendations are considered "stale and dropped." This lets the
airline in question off of the hook. Brantley said safety inspectors
have been pressured to alter actual inspection data in FAA databases.
He said inspectors have been reprimanded or removed from oversight
responsibly of a carrier's certificate.
"They have been asked
to amend a report to reflect better on the air carrier--forced to work
around the FAA's preferential treatment of airlines," he said.
He
said safety inspectors have been relegated to auditors; they're
inspecting more paperwork than they are airplanes. Because the airlines
have been allowed to submit their own data, rather than undergo
physical inspections, Brantley said there's no way to know if data is
accurate or complete. He said the FAA has retaliated against inspectors
who have attempted to hold airlines accountable. "Given the importance
of safety to air travel, the FAA is in no position to rely solely on a
data-driven system," he said.
Brantley maintains that until the
FAA recognizes who its real customer is--the flying public--its
approach to aviation safety won't change for the better.
Brantley said the same thing I've been saying for years in this newsletter; "The FAA has
promoted an internal culture where safety is given second billing," he
said. "It has manipulated every aspect of the enforcement process in
order to encourage and maintain a positive relationship between the FAA
and the airlines," he said. Punishing safety inspectors for discovering
violations or impeding them from making safety of the system their
priority shouldn't be tolerated."

What Does This Mean To You?
For many people, simply thinking about flying causes discomfort. To deal successfully with flying, it is essential to accept the necessity of thinking about it, which means accepting the feelings thinking about it causes.
In addition, it may cause you alarm to know how the FAA operates. You may have had the belief that government agencies like the FAA can be depended upon to protect you. You need to place your reliance elsewhere.
Pilots have always known how the FAA operates. As a result, we don't depend on the FAA for safety. We depend on the manufacturer, we depend on mechanics, and we depend on ourselves.
- We check the plane ourselves.
- We check the log book thoroughly.
- We speak personally with the mechanics.
- We test every system and backup system to make sure each and every one is working.
And, if the plane isn't right, we refuse to fly it. Again, refusing is easier when you have the backup of a union. I, again, suggest you keep that in mind when you choose as airline.

I answered the post tactfully, because -- as host of the message board -- I need people to be comfortably saying whatever they want to say.
Fortunately, Cap'n Steve -- who not only is an airline pilot but grew up in the airline industry since his father was also an airline pilot -- jumped in and said what needed to be said.

Side Effect -- I Now Can Go On Roller Coasters
Hi Cap'n Tom,
I just read this week's letter from an adoring fan and I have to laugh. She and I probably passed each other in Disney all week and neither of us knew it. It's been almost a year since I "Googled" fear of flying and found you and SOAR. Since then each of my flights have gotten better for me to manage, and I continue to increase my confidence in myself and in flying. I've come to realize for me this isn't a quick pill and it's "fixed" but it's an ongoing journey that I will continue to take because I WANT TO TRAVEL.
You'll laugh at this...you know what else I've gained as a side effect of your treatment?? I now can go on roller coasters (even one's that go backwards and are in the dark!), water slides with enclosed tiny tubes, and even simulation rides and enjoy them! All things I feared before because . . . well, because of living in the "what if's" instead of living in the what actually "is" going on. I now apply your methods and mindfulness to all aspects of my life. When I feel a pang of terror or dread I wonder what caused it and I deal with it - I don't hide from it and I now understand that I can push myself to heights and situations now I never thought I could and enjoy them.
Before flying I still have slight anticipatory anxiety, but I'm able to book my travel without dread, and when the flight approaches I re-listen to my tapes and I am mindful of my thoughts and needs and plan according to this. I get to the airport in plenty of time, I lessen my stress by packing snacks, magazines, and MP3 with favorite tunes, and most importantly I realize that much of my anxiety before the flight isn't really "anxiety" - it's actually excitement(!). . . which can often "feel" similar with nervous stomach issues.
I've been mindful of these feelings all year and realized I've felt these feelings all my life! I am comfortable now knowing it's just how a body, or my body, reacts to stress at review time at work, as a musician right before a concert I must perform in, putting our home on the market, preparing and flying before my very, very, recent wedding in Florida -- all similar feelings -- there's excitement, things you can't control, things you can control or are in charge of, and it all leads to stress and anxiety.
Thanks to you I'm mindful of my feelings in each situation and better able to handle it. I know I can't control everything, but I also know I'm strong enough to enjoy the experience and challenges. Your techniques are wonderful, and as always your guidance and newsletters are inspiring. Thanks again! And again!
